A.P.I.A. Membership & Pond Pass Donation, valid for 1 Year from purchase.

 

  • The Aspen Park Pond is a natural setting with areas of uneven and slippery surfaces as well as water hazards and swampy areas. Please tread lightly and carefully. 
  • You are responsible for your group’s safety. Users agree to release A.P.I.A. and the property owners of Aspen Park of all liability and hold APIA and said property owners harmless.
  • The following activities are allowed at your own risk: hiking, fishing, paddle boarding and kayaking.
  • A state fishing license is not required, only a valid A.P.I.A. Membership and Pond Pass.
  • Fishing is Catch & Release Only. Please use Barbless hooks if possible and avoid live bait. 
  • Life vests are required for on water activities in accordance with state law and are recommended for children whenever around the pond.
  • Minor children must be accompanied by an adult.
  • Pond Pass applies to member’s household & family members only and can not be extended to short term renters. 
  • Pass holders shall not conduct any for profit activities on the Pond Premises. 
  • Stay off ice that forms on the pond.
  • Please help keep our pond beautiful. 
    • Always pack-in / pack-out any trash or equipment. 
    • Clean up after your pet.
  • We do not recommend accessing the pond from US285:
    • If you choose to do so at your own risk, use extreme caution when turning onto US285 when exiting the pond area.
    • In case of a wildland fire Elk Creek FD may access the pond via the dirt road from 285. 
    • Always leave clear access so fire trucks can approach the dam area and up to the pond.
  • When accessing the pond from the trailhead near Duran Ave:
    • Do Not Park in the Vet Clinic parking lot or block any driveways.
    • Stay on the trail, keep pets on leash.
    • This is a foot trail only.
    • Parts of the trail may be inaccessible at times due to snow, ice and mud.

    Obtaining a Pond Pass constitutes a contract and the user agrees to all terms. Failure to follow rules may result in Pond Pass revocation and loss of Pond access privileges.  


Aspen Park Improvement Association (A.P.I.A.) and Aspen Park Property Owners shall not be liable and user hereby waives all claims against A.P.I.A. for any damage to any property or any injury to any person in or about the Pond Premises and its related properties by or from any cause whatsoever. User shall protect, indemnify and hold APIA harmless from and against any and all loss, claims, liability or costs (including court costs and attorney's fees) incurred by reason of (a) any loss or damage to any property, equipment (whether personal or real) or any injury to any person occurring in, on or about the Pond Premises and it’s related properties to the extent such injury or damage shall be caused by or arise from any actual or alleged act, neglect, fault, or omission by or of user, or it’s family household members to meet any standards imposed by any duty with respect to the injury or damage; (b) user failure to comply with any and all governmental laws, ordinances and regulations applicable to the condition or use of the Pond Premises and its related properties or its occupancy; or (c) any breach or default on the part of user in the performance of any covenant or agreement on the part of the user to be performed pursuant to this agreement. The provisions of this Article shall survive the termination of this use with respect to any claims or liability accruing prior to such termination (d)the conduct or management of any work or thing whatsoever done by the user in or about the Pond Premises or from transactions of the user concerning the Pond Premises. 


Purchasing an A.P.I.A. Membership and a Pond Pass Donation constitutes a contract and the user agrees to all terms.
